SOLE SOURCE VENDOR
Texas Education Code, section 44.031(j). Without complying with Subsection (a), a school district may purchase an item that is available from only one source, including:
(1) an item for which competition is precluded because of the existence of a patent, copyright, secret process, or monopoly;
(2) a film, manuscript, or book;
(3) a utility service, including electricity, gas, or water, and
(4) a captive replacement part or component for equipment.
Texas Education Code, section 44031 (k). The exceptions provided by Subsection (j) do not apply to mainframe data-processing equipment and peripheral attachments with a single-item purchase in excess of $15,000.
It is necessary for the District to obtain and retain documents from the vendor, which clearly indicates how and why an item is available from only one source.
The company will need to execute
the Affidavit of Sole Source before a notary and attach the documentation and
information that qualify this purchase as being available from only one source.
